Residents of those facilities sued the city of Crown Point, along with the developer and some of his partners, because of alleged negligence that led to the homes’ flooding. Protection from future flooding was sought in connection with the lawsuit.

Do Not File Chapter 13 if What You Need is Chapter 7

At first blush it appears that this lady was encouraged to file Chapter 13 when she really needed to be in Chapter 7, and that the only really beneficiary here is her lawyer.  On the other hand, what options did she have if she needed bankruptcy protection to stop a wage garnishment but she did not have the money to file Chapter 7?   Bankruptcy judges around the country have generally held that attorneys may not “finance” Chapter 7 fees by taking post-dated checks or post-filing installments.  Should the lawyer be vilified because his client waited far too late to seek bankruptcy counsel and a low entry-fee Chapter 13 is the only practical option?

Should I File a Chapter 13 Bankruptcy or a Chapter 7 Bankruptcy?

Another issue most people don’t consider in the process of making the choice between filing Chapter 7 or Chapter 13 is whether they have health insurance. One concern with filing a Chapter 7 bankruptcy is that it may prevent you from declaring bankruptcy or being eligible for another bankruptcy discharge for a longer period of time. If you currently have no health insurance, filing a chapter 7 could be perilous to your financial future. If you were to suffer an accident or some other medical problem and you are not insured, you will most likely have some enormous medical bills. If you have filed a chapter 7 previously, you would be barred from bankruptcy relief for a longer period of time and would more or less be suffering collection harassment and possible garnishment from medical bills that you could not get relief from because of the chapter 7 you filed. This is a valid issue and an issue that is not often discussed; however, it is one that I and the other attorneys here at Bond and Botes do consider when advising our clients as we want to help you choose the best option to afford you the most long term financial help and relief.

Chapter 13 also provides individuals with a way to reinstate their mortgage loan and get back on track with their normal payments. For a lot of homeowners who have fallen behind on their mortgage payments, they may be facing what is known as an “acceleration” of their loan, where the bank demands all of the loan be paid to avoid a foreclosure. This is basically impossible for most persons facing this problem. But, what if you could take that amount you are behind on and pay it off over 60 months and resume making your normal payments at the same time? This is possible in a Chapter 13 bankruptcy. So, if you owe $20,000 to your mortgage company and cant come up with the whole amount now, think about whether you could come up with $333.33 each month to deal with this. It may be better to pay your mortgage company back that money each month than continuing to make that car payment or credit card minimum payments each month.

Bankruptcy protects the debtor from creditors attempting to collect debts against the debtor. As soon as a debtor files for bankruptcy protection, creditors can no longer sue the debtor, file a foreclosure proceeding against a debtor’s property or try to repossess a debtor’s vehicle. After all the debtor’s unsecured debts have been discharged by the bankruptcy court, a creditor would be considered in contempt of court for pursuing collection of such discharged debt. However, a debtor is responsible for paying a creditor when the debtor reaffirms secured debt such as a mortgage on the debtor’s property or a loan on a vehicle owned by the debtor.  There are certain statutory debts that cannot be discharged in bankruptcy such as alimony, child support, federal taxes (unless they are more than three years old), student loans, court fees, costs or debts relating to fraud, embezzlement or personal injury negligence caused by the debtor to another party.

Can I Continue Contributing to a Retirement Account During Chapter 13 Bankruptcy?

During Chapter 13 bankruptcy funds are allocated to repaying debt obligations based on income ability.  The plan allows debtors to repay debt within a 3 to 5 year period.  People commonly make voluntary contributions to their retirement account via payroll deduction. Upon finalizing your Chapter 13 plan the court may request that for the duration of the repayment period, all payments toward your retirement plan be put toward debt obligations. Yet this may not always be the case.  Some courts may allow you to continue making contributions to your retirement account if you are close to retirement age.
